Hoarding Classified Documents at Mar-a-Lago

After leaving office, Trump took hundreds of classified documents — including top secret and compartmented intelligence — to his Florida resort and repeatedly obstructed government efforts to retrieve them.

After leaving the White House in January 2021, Trump took hundreds of classified documents to his Mar-a-Lago resort in Palm Beach, Florida. The materials included documents marked at the highest classification levels, including TOP SECRET/SCI (Sensitive Compartmented Information) — intelligence so sensitive that it is normally only viewed in secure government facilities.

The National Archives spent months attempting to recover the documents. Trump's team repeatedly claimed all materials had been returned, which proved false. When the Archives referred the matter to the Justice Department, a grand jury subpoena was issued. FBI agents executed a search warrant on August 8, 2022, seizing 11 sets of classified materials.

Key facts established by the investigation:

  • Over 300 classified documents were recovered from Mar-a-Lago
  • Documents were stored in unsecured locations including a bathroom, a ballroom stage, and a storage closet
  • Trump's attorneys falsely certified that all classified materials had been returned
  • Security camera footage showed boxes being moved after the subpoena was issued
  • The resort is a semi-public facility hosting weddings, dinners, and events with hundreds of guests

Trump was indicted on June 8, 2023 on 37 federal counts including willful retention of national defense information and obstruction of justice — the first ever federal indictment of a former U.S. president. Judge Aileen Cannon (a Trump appointee) later dismissed the case on procedural grounds.

In March 2026, a Smith prosecution memo accidentally released by Bondi's DOJ to Congress revealed that the FBI had determined classified documents Trump retained "would be pertinent to certain business interests" — establishing a motive for keeping them. The documents were found "commingled with documents created after Trump left office." At least one document was so restricted that only 6 people in the entire government had access to it. Trump also showed a classified map to passengers on his private plane, including Susie Wiles, now his White House Chief of Staff.
